Why A is correct

Under 28 TAC 3.3301-.3325, the Texas Department of Insurance has adopted minimum standards for Medicare supplement policies, and a policy must meet those standards and be filed with and approved by TDI before it may be delivered or issued for delivery in Texas. Federal approval of an insurer's Medicare business, or the appointment of the selling agency, does not substitute for that state filing, so an agent selling a form that was never approved in Texas is selling a noncompliant policy.

Why the other options are wrong

  • B) Medicare supplement policies are issued on individual forms, and there is no requirement that coverage be written under a group master policy.
  • C) Federal review does not displace the state filing and approval requirement administered by TDI.
  • D) The distribution channel is regulated separately; using an appointed agency does not relieve the form from the minimum standards.
