Under Fla. Stat. 627.6741(2)(b), a Medicare supplement policy may exclude a preexisting condition only if it was diagnosed or treated within the 6 months before the effective date, and even then the exclusion can last no more than 6 months. A lifetime exclusion of any preexisting condition regardless of timing is prohibited. By contrast, a Med Supp need not cover services Medicare does not cover at all, so those exclusions are proper.
