MHPAEA, implemented through 45 CFR Parts 146 and 147, imposes parity: financial requirements such as copayments, and treatment limitations, for mental health and substance use disorder benefits may be no more restrictive than the predominant requirements applied to medical and surgical benefits in the same plan.
