Aviation Exclusion (Life)

Add an exclusion endorsement for that activity, in some cases with a refund of the premium attributable to the excluded coverage — When an insured begins a hazardous activity after policy issue, the insurer may attach an exclusion endorsement limiting coverage for that activity, often with a refund of the premium attributable to the excluded coverage. The insurer cannot retroactively void an already issued policy merely because of a newly adopted avocation without a basis in the contract. Endorsements that modify coverage require proper notice, and refunding the unearned premium is a common element of such exclusions. This approach keeps the base coverage intact while removing the newly added high-risk exposure from the insurer's liability.

Death while piloting a private plane for pleasure — A standard aviation exclusion applies to noncommercial or private flying, typically when the insured is piloting or acting as a crew member of a private aircraft, or flying in an aircraft not operated by a licensed commercial carrier on a scheduled route. Deaths while a passenger on a scheduled commercial airline are ordinarily covered, as are unrelated causes like a heart attack while boarding. The exclusion targets the extra hazard of private flight, not routine commercial travel. Insurers may charge a higher premium or add an endorsement for pilots.
